Terms & Conditions

By using VoiGu, you agree to these Terms. Please read them carefully β€” they cover accounts, subscriptions, acceptable use, and your legal rights.

1. Agreement to terms

These Terms and Conditions (β€œTerms”) form a binding agreement between you and VoiGu, Inc. (β€œVoiGu,” β€œwe,” or β€œus”) and govern your use of our mobile applications, website at voigu.com, and related services (the β€œService”).

By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

To use VoiGu you must:

  • Be at least 13 years old (or 16 in the European Economic Area, the United Kingdom, and Switzerland; the age of digital consent in your country if higher).
  • Have the legal capacity to enter into a binding contract in your jurisdiction.
  • Not be barred from receiving the Service under the laws of your country or any other applicable jurisdiction.

If you are under 18, you must have your parent or legal guardian review and accept these Terms on your behalf.

3. User accounts

To access certain features (cross-device sync, leaderboards, subscriptions), you'll need a VoiGu account. You may register with an email address or sign in through Apple, Google, or Facebook, all handled by Firebase Authentication.

You are responsible for:

  • Providing accurate, current, and complete information when registering.
  • Keeping your password secure and notifying us immediately of any unauthorized access.
  • All activity that occurs under your account, whether you authorize it or not.

We may suspend or terminate accounts that violate these Terms, are used fraudulently, or remain inactive for extended periods.

4. Guest accounts

VoiGu lets you start learning without creating an account using Guest Mode. Guest progress (XP, streak, hearts, completed lessons) is tied to a single device and synced via an anonymous identifier.

  • Guest accounts cannot purchase subscriptions, use social features, or recover progress if your device is lost or reset.
  • You can convert a Guest account into a registered account at any time; your progress will transfer automatically.
  • Guest data is automatically deleted after 90 days of inactivity.

5. License to use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the VoiGu app on devices you own or control, and to access the Service for your personal, non-commercial use.

This license does not give you the right to:

  • Resell, sublicense, distribute, or commercially exploit the Service.
  • Copy, modify, or create derivative works based on any part of the Service.
  • Reverse-engineer, decompile, or attempt to extract the source code, except where applicable law expressly permits.
  • Use automated means (bots, scrapers, crawlers) to access or extract data from the Service.

6. Acceptable use

You agree not to:

  • Use the Service for any illegal, harmful, fraudulent, or abusive purpose.
  • Upload or transmit malware, spam, or any content that infringes intellectual property rights, defames others, or violates privacy.
  • Manipulate the streak system, leaderboards, or XP through unauthorized scripts or third-party tools.
  • Attempt to bypass security features, rate limits, or paid-content gates.
  • Use the Service to harass, threaten, or harm any individual or group.
  • Impersonate another person, including any VoiGu employee or representative.
  • Interfere with the operation of the Service or with other users' use of it.

We reserve the right to investigate violations and to take appropriate action, including warning, suspending, or permanently terminating accounts.

7. User-generated content

You may submit content to VoiGu β€” including profile information, voice recordings during lessons, AI conversation messages, support requests, and feedback (β€œUser Content”).

You retain ownership of your User Content. By submitting it, you grant VoiGu a worldwide, royalty-free, non-exclusive license to host, store, reproduce, and use that content for the limited purpose of operating, providing, and improving the Service.

You represent that your User Content does not violate any third party's rights and complies with these Terms. We may remove content that we reasonably believe violates these Terms, applicable law, or community standards.

8. Subscriptions & payments

VoiGu offers free, VoiGu Plus, and VoiGu Family tiers. Paid tiers are billed through the Apple App Store or Google Play; on the web, payments may be processed by Stripe.

  • Subscription pricing is shown at the point of purchase and may vary by country, currency, platform, and promotion.
  • Subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current price unless you cancel beforehand.
  • Apple and Google handle billing, taxes, and renewals according to their respective terms. We do not store your payment card details.

9. Free trials

New subscribers may be offered a free trial period (typically 7 days). If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and you will be charged at the standard price.

Free trials are limited to one per user, household, or payment method. We may withhold a free trial from accounts we suspect of abuse.

10. Cancellation & refunds

You can cancel your subscription at any time:

  • iOS β€” Settings β†’ [Your Name] β†’ Subscriptions β†’ VoiGu β†’ Cancel.
  • Android β€” Google Play β†’ Subscriptions β†’ VoiGu β†’ Cancel.
  • Web β€” Settings β†’ Subscription β†’ Cancel.

Cancellation takes effect at the end of your current billing period. You retain access to paid features until then.

Refunds are governed by the platform you purchased through:

Where required by applicable consumer law (e.g., the EU Consumer Rights Directive), you have a 14-day right of withdrawal. By starting to use paid digital content immediately, you may waive that right.

11. AI tutor & conversation features

VoiGu uses artificial intelligence β€” including our adaptive tutor β€œGu” and AI conversation mode β€” to personalize lessons and simulate dialogue.

  • AI responses are generated by machine-learning models and may be inaccurate or unexpected. VoiGu does not guarantee that AI output is correct, culturally appropriate, or suitable for any particular purpose.
  • Do not rely on AI conversation for medical, legal, financial, or other professional advice.
  • Audio submitted to AI features may be transcribed in real time. See our Privacy Policy for how voice data is handled.

12. Intellectual property

The Service β€” including all lessons, audio, illustrations, software, text, brand elements, and the β€œGu” mascot β€” is owned by VoiGu or our licensors and is protected by copyright, trademark, and other intellectual property laws.

β€œVoiGu” and the VoiGu logo are trademarks of VoiGu, Inc. You may not use them without our prior written consent. All other trademarks are the property of their respective owners.

13. Third-party services

The Service integrates with third parties, including:

  • Apple App Store, Google Play, and Stripe (billing)
  • Google Firebase (authentication, database, analytics, push notifications, crash reporting, and hosting)
  • Apple, Google, and Facebook sign-in providers
  • Email delivery and customer-support tools

Your use of these third-party services is governed by their own terms and privacy policies. We are not responsible for third-party services or content.

14. Disclaimers

The Service is provided β€œas is” and β€œas available.” To the fullest extent permitted by law, VoiGu disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that you will achieve any particular level of language proficiency or fluency. Learning outcomes depend on your effort, consistency, and individual circumstances. Streak, XP, and progress metrics are tools, not promises.

15. Limitation of liability

To the fullest extent permitted by law, VoiGu and our officers, directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) USD $100.

Some jurisdictions do not allow limits on certain liabilities, in which case those limits will apply only to the maximum extent permitted by law.

16. Indemnification

You agree to indemnify and hold harmless VoiGu and our affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or any applicable law.

17. Termination

You may stop using the Service and delete your account at any time in Settings β†’ Account β†’ Delete account. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users.

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and disputes survive termination.

18. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. If you reside in a jurisdiction whose mandatory consumer-protection laws apply to you, those laws also apply, and nothing in these Terms removes rights you have under them.

19. Disputes & arbitration

Most disputes can be resolved by emailing legal@voigu.com. If a dispute cannot be resolved informally:

  • Disputes will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, unless prohibited by your local law.
  • You waive the right to participate in any class action or class-wide arbitration, except where prohibited.
  • You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@voigu.comwith the subject line β€œArbitration Opt-Out.”

Residents of the EEA, UK, and other jurisdictions where binding arbitration is restricted are not subject to mandatory arbitration and may bring claims in their local courts.

20. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email at least 14 days before the new Terms take effect. Continuing to use the Service after the effective date constitutes acceptance of the updated Terms.
